The U.S. Department of Justice (DOJ) has requested records from two nonprofits regarding sensitive voter data they obtained through various state motor vehicle departments. The inquiry followed concerns raised last month by the Department of Homeland Security (DHS) surrounding the possible violation of privacy laws.
The nonprofit organization Electronic Registration Information Center (ERIC) helps states maintain their voter rolls. DHS alleged that the nonprofit recently shared data, including Social Security numbers and driver’s license numbers, with at least one other private organization in violation of the Driver’s Privacy Protection Act (DPPA).
“Even apart from the issue of disclosure to third parties, the scope of ERIC’s own use of DPPA-protected personal information remains unclear,“ said Associate Attorney General Stanley Woodward. “Although using such information in furtherance of government functions may be a permitted use, using protected information for certain partisan purposes is not a government function and is thus not permitted under the DPPA — regardless of whether a state consents.”
