Greece’s foreign minister said a 2019 maritime boundaries memorandum between Turkey and Libya remains legally invalid, delivering the position on behalf of Greece, Egypt, Cyprus, Bahrain, the United Arab Emirates and the European Union, according to Euronews. Giorgos Gerapetritis said the memorandum has no legal effect, conflicts with international law and cannot serve as a lawful basis for delimiting maritime zones or produce legal consequences for third states.
The joint statement responded to a recent decision by Libya’s House of Representatives to ratify the 2019 Turkish-Libyan memorandum on maritime jurisdiction areas in the Mediterranean, which the signatories said raises serious concerns for regional security and stability.
The statement pointed to a wider challenge for the international legal order, stressing the need to ensure that arbitrary bilateral agreements do not weaken established rules of international law or harm the rights of third states.
Gerapetritis said international law, particularly the United Nations Convention on the Law of the Sea and customary international law, provides the framework for delimiting maritime zones. He described those rules as fundamentally important for predictability, legal certainty and peaceful relations among states.
He also warned that accepting bilateral agreements that disregard applicable rules and principles of international law would set a dangerous precedent, undermining the international legal order and the principles underlying the peaceful settlement of disputes.
According to the statement, the memorandum ignores the geographical reality and the rights of all coastal states involved over maritime zones, including the rights of islands under the United Nations Convention on the Law of the Sea. The statement added that the subsequent decision by Libya’s House of Representatives does not change this legal reality.
The signatories reaffirmed their commitment to reunifying Libya’s institutions and to the prospect of a united and prosperous Libya, stressing that a stable Libya actively engaged in regional cooperation is essential for peace and security in the Mediterranean. They also said Libya’s political transition and its relations with its neighbours must be governed by respect for international law and good-neighbourly relations.
